CMS has released an amendment to the 2023 fee guidance for the federal independent dispute resolution process under the No Surprises Act: Change in Admin Fee. The Departments of Health and Human Services, Labor, and the Treasury are amending the prior 2023 guidance to increase the administrative fee for the federal independent dispute resolution (IDR) process from $50 to $350 per party for disputes initiated during the calendar year, which began January 1. These changes are described further in Section II of this guidance. No changes have been made to the 2023 certified IDR entity fee ranges for single or batched determinations
